I INTRODUCTION
These Terms and Conditions regulate the NH+ BUSINESS PROGRAM (hereafter, the “NH+ Program”), owned by Minor Hotels Europe & Americas, S.A. with registered offices in Madrid, C/ Santa Engracia nº 120, and Tax ID number A-28027944 (hereafter, ‘Minor Hotels’).
These terms and conditions specify how the NH+ Program operates as well as the process for members of the NH+ Program (hereinafter, the “Member” or “Members”). Members shall at all times have access to the up-to-date and valid general terms and conditions which regulate the NH+ Program (hereafter, ‘Terms and Conditions’), by looking at the Minor Hotels website, in order to at all times be fully informed of the Terms and Conditions applicable to them as Members, and of which they declare to have knowledge.
By expressly accepting said Terms and Conditions or, where relevant, by accepting them without the need for a conventional signature, Member declares to have knowledge of the content of such Terms and conditions and to remain subject to them for the duration of their membership of the NH+ Program.
The Member may benefit from the advantages inherent in the NH+ Program only in those hotels and for those services and rates included at any given point in the NH+ Program. Members shall be duly informed about the hotels and services included in the NH+ Program and their relevant rates. Such list shall be updated from time to time and such variations will be shown in the Minor Hotels Website and they also will be communicated to the Members via email.
Minor Hotels reserves the right to unilaterally modify these Terms and Conditions at any time and to modify the list of hotels, services, benefits, and rates included in the NH+ Program. Said new Terms and Conditions will be made available to the Member in the same way and form as these Terms and Conditions.
The NH+ Program is regulated with immediate effect by these Terms and Conditions, and it is expressly declared that any previous general terms and conditions of the NH+ Program are hereby cancelled and replaced by these Terms and Conditions.
II NH+ PROGRAM MEMBERSHIP
1 – The NH+ PROGRAM
The NH+ Program provides exclusive rates and offers for registered companies and self-employed. Members now have additional benefits and advantages for both business and leisure trips. These benefits and advantages are non-transferable, and they may not be assigned to third parties.
2 – Members
Any company and self-employed can registered to be a Member of the NH+ Program.
3 – NH+ Program Enrolment Process
New Member
Enrolment in the NH+ Program is free. Any dully registered company or any person over the age of 18 (in case of self-employed) may sign up for the NH+ Program, once they have read and expressly accepted its Terms and Conditions of participation through the channels that Minor Hotels has enabled for this purpose at any time.
Any company or self-employed can request enrolment into the NH+ Program through the following channels:
- NH PRO website: go here and complete the registration form online.
- Minor Hotels Customer Care Call Centres: contact us in order to manage your request correctly. Please find your Minor Hotels Customer Care Call Centre here
- or any other means made available by Minor Hotels in which the Member can give their express consent to enrolment in the NH+ Program.
During the registration process the potential Member must filled all the required information and provide a valid email address to be able to enrol in the NH+ Program. Once the registration is sent, it could take around 24 hours to receive the online credentials to the online booking tool NH PRO. While the registration request is in process, the potential Member will be provided with a temporary link to access the NH+ Program and make their first bookings within the NH+ benefits. The revenue generated and room nights spent in this link will not be accounted to the Member as it is a temporary link.
Once the registration request has been proceeded, the Member will receive a welcome email to the NH+ Program with the membership number. From such welcome email the Member shall be able to set a password to access to the NH PRO website.
Once the new password has been set, the Member will be able to access to the NH PRO website using their email and password. The invoice revenue booked, and room nights spent through this channel will be counted in the NH PRO account to improve the customer experience.
New user within the Member
In the event of an existing Member of the NH+ Program wants to register an additional user to NH PRO (the “Additional User”), it can be done through this sign up form.
During the registration process, the Additional User must follow the same process as provided for New Members: fill all the required information and provide a valid email address to be able to enrol in the NH+ Program. Once the registration is sent, it could take around 24 hours to receive the online credentials to the online booking tool NH PRO.
Once the registration request has been proceeded, this Additional User will receive a reset password email to set a password. Once the new password has been set, the Additional User will be able to access to NH PRO using their email and password, the invoice revenue booked and room nights spent through this channel will be counted in the NH PRO account to improve the customer experience.
Modification of information
If the Member needs to change any information, it will need to contact the Customer Care Call Centre here.
4 – Benefits of the NH+ Program
The NH+ Program offers several discounts to Members. The rate discounts apply to all our NH Hotels, NH Collection and nhow hotels worldwide and all Tivoli, Anantara and Avani hotels established in Europe and they are subject to the hotel availability. Minor Hotels reserves the right to amend the list of hotels included in the NH+ Program or eligible rates.
The are no restricted days to enjoy the benefits as the rate can be used for Member’s business and leisure trips.
The NH+ Program rates are only applicable for future reservations once registered. In this way, if the client already has future reservations before signing up to NH+ Program, the NH+ Program rates will not be applied on those reservations.
The member/company can only book a maximum of 9 rooms for the same dates and same hotel with the NH+ rates and benefits. For reservations of more than 9 rooms group special fares and conditions apply.
The Member can book the rates and join the benefits through any direct channel as the reservation centre, hotels, our dedicated online bookings tools, NH PRO, CCG links, personalized booking Minor Hotels tool, or intermediated by any agency or GDS. All bookings made through online sales channels outside the Minor Hotels channel, OTAs or through intermediaries are excluded.
Members will always count with the following benefits independently of the booking channel:
- DISCOVERY Dollars (D$) accrual: Earn DISCOVERY Dollars (D$) for NH DISCOVERY member business travellers when booking direct, on our contact centre, app, web or directly in our hotels.
As a NH+ member you can earn points for each room when booking only through Minor Hotels website, app, Central Reservation Office or via our app, except for group, meeting and conference, air crew, travel agent or long-stay rates. Also excluded are all bookings made through online sales channels outside the Minor Hotels channel or through intermediaries.
Minor Hotels reserves the right to amend the list of eligible rates. This list can be consulted through NH DISCOVERY Members’ Customer Care Centre or in hotels that are part of the Programme. Please check NH DISCOVERY terms and conditions for more details.
- 5% discount on MICE bookings. Subject to availability. The discount is only applicable to companies that book direct and that are NH+ members. Valid only for groups with a contracted meeting room or F&B services. Notwithstanding the above benefits, which apply in any case for all Member of the NH+ Program independently of the booking channel, there are additional and different benefits depending on the Member books through via the NH PRO website vs other channels.

When booking through any of our dedicated online booking tools, discounts and other benefits will be offered to the Member depending on the program category they currently are. The category is based on the number of room nights spent with Minor Hotels independently of the booking channel in 1 natural year from subscription date.

- 5% discount on MICE bookings.Subject to availability. The discount is only applicable to companies that book direct and that are NH+ members. Valid only for groups with a contracted meeting room or F&B services. Discount applicable on total net group revenue (applicable on Guest rooms, Meeting room rental, F&B and in-house contracted services). III. CANCELLATION OF THE PARTICIPATION IN THE NH+ PROGRAM
Membership in the NH+ Program has no expiry date, but the account may be cancelled together with membership in the NH+ Program for any of the following reasons:
1 – At the request of the Member
Members may at any time withdraw their participation in the NH+ Program. To do this, Members must send their written request to withdraw from the NH+ Program via email to the relevant email accounts provided here: Contact for business and providing the relevant email address associated with their account. This voluntary cancellation will involve the automatic loss of all benefits and advantages.
2 – At the request of Minor Hotels
Minor Hotels reserves the right to temporarily suspend or permanently cancel the membership of any Member of the NH+ Program for any of the following reasons:
- When the Member has not made use of the products and services offered by Minor Hotels for a period of 12 months.
- When improper or fraudulent use has been made of the NH+ Program: breach of Terms and Conditions, payment irregularity or inappropriate conduct in the hotel, notwithstanding claims for damages which could be filed by Minor Hotels.
- In the event of force majeure or due to legal, governmental or any other type of enforcement which makes it necessary to cancel the NH+ Program.
- When required to do so for reasons of Minor Hotels corporate strategy.
- Due to the dissolution of the company or the death or disappearance of the self-employed.
In all the aforementioned cases, the Member shall automatically lose the right to use and enjoy the advantages associated with the NH+ Program. In each and all the cases listed above, this being a NH+ Program which is free for the Member, the latter expressly waives their right to damages against NH due to cancellation of the membership or the NH+ Program.
The assignment of the membership of the NH+ Program is strictly prohibited and will result in the immediate cancellation of the participation in the NH+ Program.
IV LIABILIY
Minor Hotels shall not be liable for:
- Any failure of the Member to comply with the stated obligations.
- Any deficiency or failure in the system, website, online booking tool or data processing, which is not directly attributable to Minor Hotels, or which is outside of Minor Hotels’ reasonable control.
- Any indirect or consequential damage caused to the Member that could result from the membership of the NH+ Program or from any of the advantages or services provided pursuant to the present conditions.
- The reliability, availability and continuity of the services made available online to the Member, thus excluding any liability for damages of any kind which may arise from a lack of availability, reliability or continuity of its website or its services, although it will try to facilitate, to the extent of its capabilities, technical support for the person affected.
Minor Hotels does not undertake to control and does not have any prior control over viruses or elements contained within them which may alter the software or hardware of the user or of persons visiting the web pages and will therefore not be liable for damages of any kind which may arise from the same.
V CONFIDENTIALITY AND DATA PROTECTION PRIVACY POLICY
This section provides the data protection information to be included in the NH+ Program terms and conditions.

2 – For what purposes will Minor Hotels process Members’ and users’ personal data and on what legal grounds?
We would like to inform you that the data provided in the registration process for the NH+ Program are processed by Minor Hotels for the following purposes:
- To register people in the NH+ Program. This processing is legitimate by virtue of the contractual relationship between the parties.
- To send communications by e-mail or electronic media with content about special offers and prices for members of the NH+ Program, unless you state otherwise by making an opposition to this data processing.This treatment is legitimized by the acceptance of these terms and conditions. The user may at any time object to these communications by mail to dataprotection@nh-hotels.com, as well as through the means included in each communication.
- To create an account associated with the registration which will allow access to the Minor Hotels website, in order to make it possible to manage the Member’s account, to communicate with the person in charge and to manage the account.This processing is legitimate by virtue of the contractual relationship between the parties.
- To send communications relating to Members’ accounts, including, but not limited to, registration, notifications, errors and/or problems related to their account and any other communications to keep them informed about the status of their account. This processing is legitimate by virtue of the contractual relationship between the parties.
- To measure Members’ degree of satisfaction with the service provided, in those cases where they have stayed at one of the Group’s hotels. This purpose may include sending quality surveys and tailoring and personalising the services provided by Minor Hotels. This processing is legitimised by the legitimate interest held by Minor Hotels.
Minor Hotels may contact the Members in order to satisfy its legitimate interest in controlling the quality of its services and assessing customer satisfaction by requesting their assessment of the products and services offered and/or purchased and by analysing this information in order to improve its services.
This processing responds to Minor Hotels’ need to tailor its operations and the products and services offered to the preferences and expectations of Members, which makes it necessary to know their opinion. This processing also helps to improve the quality of the services provided to Members. Although responses will be collected on an inpidual basis in order to analyse opinions, they will be analysed in a general way, by means of statistics, without identifying specific Members. In any event, Members can refuse to give their assessment, and can also communicate their opposition to being contacted for this purpose.
3 – To personalise the services offered to Members of the NH+ Program, by studying their profile and tastes. This processing is legitimised by the legitimate interest held by Minor Hotels.
In order to improve the receptiveness to the products offered, Minor Hotels will prepare a profile based on Members’ and Additional Users’ personal characteristics (e.g. stays in hotels) and the information obtained from their actions as a user.
This purpose responds to the need to make personalised offers to each of the Members of the NH+ Program (including by electronic means, when authorised), to make it possible for Members to purchase their preferred products and similar alternatives, and to offer them products that may be of interest to them based on their profile (automated decisions may be taken for this purpose). As a result, Members will benefit from offers tailored to their preferences and tastes, as expressed through their activity or deduced from the characteristics of their profile. Members’ profile information will be treated securely and confidentially and will only be processed in systems that analyse the information obtained in an automated way. Moreover, Members may express their wish not to be included in such processing at any time by exercising their right to object to such processing.
4 – What Member data will Minor Hotels process?
Minor Hotels will process the following categories of data:

- Data provided to measure users’ degree of satisfaction with the service provided.
– Identification data: Name, surname(s).
– Contact information: e-mail address.
– Details of services provided: Stays in Minor Hotels.
- Data provided to personalise the services provided to Members of the NH+ Program
– Identification data: Name, surname(s).
– Contact information: e-mail address.
– Details of services provided: Stays in Minor Hotels.
- With whom will Members’ data be shared?
Minor Hotels Group companies, all of which are active in the hotel sector, will need access to Members’ data in order to provide services linked to the NH+ Program properly. Their data will also be communicated to those entities that own hotels that may be included in the NH+ Program so that they can be informed of the conditions of their stay (price, dates, services included, etc.).
Therefore, the Member agrees that their data may be accessed by Minor Hotels Group companies (which you can access www.nh-hoteles.es, some of which may be located outside the European Economic Area and even in countries that do not offer a level of protection comparable to that of Spain) for the sole purpose of being able to provide services properly.
- International data transfers
We hereby inform the Member that their data may be transferred to third countries as indicated in the previous section, given that some Minor Hotels Group companies are located outside the European Economic Area. This transfer will be made in order to provide you with any services associated with the NH+ Program that the Member requests.
We also inform the Member that if there is any billing associated with the NH+ Program, their data may be transferred to third countries located outside the European Economic Area, specifically to the USA, India and the Philippines. The aforementioned transfer will be carried out as a consequence of the services provided by Accenture to Minor Hotels in relation to managing the back office related to the company’s billing system. In this regard, please note that this is regulated by means of standard contractual clauses, which have been authorised beforehand by the Spanish Data Protection Agency (AEPD).
Data will be stored by Minor Hotels as the data controller in accordance with the following guidelines.
- Data provided for registration in the NH+ Program.Data will be stored for as long as the Member is registered in the NH+ Program and, once the contractual relationship has ended, until the expiry of any liabilities that may have arisen for any of the parties.
- Data provided to create an account associated with registration. Data will be stored for as long as the Member is registered in the NH+ Program and, once the contractual relationship has ended, until the expiry of any liabilities that may have arisen for any of the parties.
- Data provided for sending communications related to accounts. Data will be stored for as long as the Member is registered in the NH+ Program and, once the contractual relationship has ended, until the expiry of any liabilities that may have arisen for any of the parties.
- Data provided for sending communications related to offers. Data will be stored until the Member objects to the processing of your data withdraws his/her consent to receiving commercial communications, or objects to them through the means made available by Minor Hotels to the user in each of the commercial communications sent.
- Data provided to measure Members’ degree of satisfaction with the service provided. Once the user’s assessment has been received, their personal data will be deleted, as the assessment of services is carried out in an anonymised manner.
- Data provided to personalise the services provided to Members of the NH+ Program. Data will be stored for as long as the Member is registered in the NH+ Program and, once the contractual relationship has ended, they will be deleted.
7 – Commercial communications
In order for the Member to enjoy all the benefits of the NH+ Program, the Member will receive news, promotions and offers that best fit their profile through different channels, including electronic media, and to receive communications about their NH+ Program balance, points and categories, and promotions and offers from our NH+ Program Partners. As part of Minor Hotels’ commitment to Member’s privacy, Minor Hotels would like to remind that the Member may access the terms and conditions of the NH+ Program at any time at the following address dataprotection@nh-hotels.com and object to data processing to receive these communications by sending an email to dataprotection@nh-hotels.com or via the link provided for this purpose in each of the communications.
8 – Processing of third-party data
In the event that Data Subjects provide third party data at any time, they declare that they have the consent of such third parties and undertake to transfer the information contained in this clause to them, and to inform Minor Hotels of any changes or updates relating to such data.
9 – Data security
Minor Hotels has adopted the necessary technical and organisational measures to ensure the security of personal data and prevent its unauthorised alteration, loss, treatment or access, taking into account the state of the technology, the nature of the data stored and the risks to which they are exposed, whether from human action or physical or natural means.
As the Data Subject, the Member is responsible for maintaining the strict confidentiality of their user password, and for accessing or using our website or the NH+ Program service, or for using their own password or its us by any person to whom you provided it previously, regardless of whether such access or use was authorised by you or on your behalf, and whether or not such person is your employee, relative or agent. The Member agrees to (i) inform Minor Hotels immediately of any unauthorised use of your password, account or other breach of security and (ii) ensure that the Member logs out of their account at the end of each session. The Member, as the Data Subject, are solely responsible for monitoring the dissemination and use of their password, access to and use of their account, and for informing us if the Member wishes to terminate your account.
10 – Rights of Data Subjects in relation to their data.
The Member may exercise the following rights at any time and free of charge, by writing to the address of the Data Controller which can be found in the heading of this document, using the reference “Data Protection”, and enclosing a photocopy of their identity document:
- To revoke the consent given for processing and communicating their personal data.
- To obtain information about the existence or non-existence of processing of their personal data.
- To access their personal data.
- To rectify inaccurate or incomplete data.
- To request the deletion of their data when the data are no longer necessary for the purposes for which they were collected, among other reasons.
- To limit the processing of data when any of the conditions provided for in the data protection regulations are met.
- In certain circumstances and on grounds relating to their particular situation, persons concerned may object to the processing of their data.
- To request the portability of their data.
- To lodge a complaint with the Spanish Data Protection Agency, at the following address: Calle de Jorge Juan, 6, 28001 Madrid, when the Member believes that the data controller has infringed the rights recognised by the data protection regulations.

VI PLACE OF JURISDICTION AND APPLICABLE LAW
These Terms and Conditions shall be interpreted and applied in accordance with Spanish law. Minor Hotels and the Member, expressly waiving any other jurisdiction, are subject to the Member’s local courts for any dispute arising from use of the NH+ Program. If the Member is resident outside Spain, and there is no regulation to establish another jurisdiction, Minor Hotels and the Member are subject, expressly waiving any other jurisdiction, to the courts of the city of Madrid (Spain).
